Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed through our online shop at www.kunstform.org and purchases made at our retail store in Stuttgart, operated by kunstform GmbH, Rotebühlstr. 63, 70178 Stuttgart, Germany - for consumers (private customers, § 13 German Civil Code) and businesses alike.
2. Conclusion of Contract
The presentation of products in our shop does not constitute a binding offer. By clicking the order button, you submit a binding offer to purchase. The purchase contract is only concluded upon delivery of the goods. The order confirmation email merely confirms receipt of your order, not acceptance of your offer.
Before submitting your order, you will see a summary where you can review and correct all details. The contract language is German; the shop is also available in English.
3. Prices and Payment
All prices are final prices including statutory VAT. Customers with a delivery country outside the EU see prices without VAT. The delivery country is detected automatically based on your browser settings and can be changed at any time via the country selector in the header (flag icon, top right) or through the delivery address saved in your customer account.Shipping costs are shown in the shopping cart, at checkout, and on our Shipping Costs & Delivery Time page.
For deliveries outside the EU, additional customs duties and taxes may apply - these costs are not covered by us and must be paid by you.
Available payment methods are listed on our Payment Methods page. Payment processing is handled by:
- PayPal - PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg (Terms of Use). Installment payments and purchase on account (subject to credit check by PayPal) as well as credit card payments are available.
- Stripe - Stripe Payments Europe, Ltd., Dublin, Ireland (Terms of Use). Credit card, Apple Pay, Google Pay, Klarna, iDEAL (Netherlands), BLIK (Poland), and many more payment methods are available via Stripe.
- Bank transfer - You transfer the invoice amount and we ship once payment is received. As a small thank-you we give you a 0.5% discount.
- Cash on delivery - Payment upon delivery to the parcel service. Germany only. Fees shown on Payment Methods page.
- Cash / Debit card - For in-store pickup.
4. Delivery and Shipping
Goods are shipped to the delivery address you provide at checkout.
Delivery times: within Germany typically 1-3 business days, EU 3-7 business days, worldwide 5-14 business days - after the goods have been handed over to DHL (for bank transfer, after receipt of payment). Partial deliveries are possible at no additional cost to you. More information at Shipping Costs & Delivery Time.
In-store pickup at our retail store (Rotebühlstr. 63, 70178 Stuttgart) is available - no shipping costs apply. We will let you know as soon as your order is ready for pickup.
5. Right of Withdrawal
As a consumer (private customer), you are entitled to the statutory 14-day right of withdrawal, during which you may cancel your order without giving any reason. In addition, we voluntarily extend this period to a total of 30 days. Full details and the model withdrawal form can be found in our Cancellation Policy.
6. Vouchers
Gift vouchers (purchased) can be redeemed in the online shop and in-store. They are valid for 3 years, transferable, and can be combined with other payment methods. Cash payout is not possible.
Promotional vouchers (free, issued during campaigns) are valid only in the online shop and only during the specified period. One promotional voucher per order. Remaining balance is not refunded. Promotional vouchers are not reissued after withdrawal.
7. Warranty
Statutory warranty rights apply. If you notice obvious transport damage upon delivery, please report it to the delivery driver and inform us. This has no effect on your statutory warranty claims.
Normal wear and tear is not covered by the warranty. The same applies to defects caused by not following care or maintenance instructions, modifications to the product, improper installation of accessories, the use of unsuitable care products, or overloading.
A legal guarantee does not apply unless explicitly stated in the product description on our website.
8. Liability
kunstform is fully liable for intentional misconduct, gross negligence, and for injury to life, body, or health.
For slight negligence, we are only liable for breach of material contractual obligations - limited to foreseeable, contract-typical average damages. This also applies to slight negligence by our employees and agents.
Liability under the Product Liability Act remains unaffected in all cases.
9. Batteries and Rechargeable Batteries
Batteries and rechargeable batteries must not be disposed of in household waste. As a consumer (private customer), you can return them to us in-store free of charge after use, or drop them off at local collection points. For full information see our Battery Disposal page.
10. Final Provisions
German law applies, excluding the UN Convention on the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
Place of jurisdiction for merchants and entrepreneurs is Stuttgart.
EU online dispute resolution platform: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings.
Should any provision of these terms be invalid, the remaining provisions shall remain in effect.
